Tell the DEP No More Toxic Slurry
Massey Subsidiary, Marfork Coal Company, has submitted for a permit renewal for Marfork Processing Plant, the coal prep plant connected to the largest coal impoundment in the country, the Brushy Fork Slurry Impoundment. The comment period is closed, but if you leave your comments in the box, they will be read and entered into the official record at the informal conference on March 5. - On December 10th, 2005 this coal processing facility released at least 10000 gallons of toxic slurry into the Coal River, which serves as the source of drinking water for thousands of people. This plant poses an unacceptable danger for the people of the Coal River Valley.
- The toxic coal slurry from this plant is being placed behind the tallest dam in the hemisphere. The impoundment has been undermined by Marfork mines and the containing ridges of the impoundment have also been subject to extensive underground mining. There are now plans to blast on top of one of these ridges. The continued filling of this impoundment, up to 9 billion gallons, is dangerous and irresponsible.
- Marfork Coal, which only operates in a small area, has had 240 violations written up on its activities, including 46 on the procession plant and 72 on the Slurry impoundment. They are clearly not acting in a responsible manner.
- Even though it has been mandated to by the West Virginia State Legislature, the DEP has not completed the study on coal slurry that they were supposed to have finished in December of 2007 and the DEP has missed 3 deadlines agreed upon for the completion of the study. The DEP should not be allowing the production of coal slurry without knowing the impacts.
- The DEP is significantly understaffed with over 100 job vacancies and does not have the capability to properly monitor this dam or this outlaw coal company.
